Why Do Most Charter Yachts Take 12 Guests or Fewer?
Twelve passengers is where international rules start treating a vessel as a passenger ship. Where the limit comes from, the exceptions, and why the guest count matters on a first call.

Most charter yachts take 12 guests or fewer because 12 passengers is the line above which international rules usually treat a vessel as a passenger ship, which on international voyages must comply with conventions such as SOLAS. Yacht codes such as the Red Ensign Group Yacht Code are written for commercial yachts that carry no more than 12 passengers, and Burgess notes that the majority of charter yachts cruise with 8 to 12 guests depending on their length. For a broker, that makes the guest count one of the first numbers to get exactly right.
Where the 12 comes from
The International Maritime Organization describes passenger ships as "usually defined as a ship carrying more than 12 passengers," and says those on international voyages must comply with the relevant IMO regulations, including the SOLAS and Load Lines conventions.
Commercial yachts that carry 12 passengers or fewer can instead be certified to a yacht code. Part A of the Red Ensign Group Yacht Code, published by the UK Maritime and Coastguard Agency as MSN 1895, applies to yachts of 24 meters and over in load line length, with keels laid on or after January 1, 2019, that are in commercial use for sport or pleasure, carry no cargo and carry no more than 12 passengers. Yachts that carry more than 12 passengers fall under Part B of the same code.
The practical result: a yacht certified for 12 passengers is not a smaller version of a 14-passenger yacht. It is built to a different standard.
The exceptions callers ask about
Bigger groups on bigger yachts. Burgess notes that some yachts built to the Passenger Yacht Code can carry up to 36 guests, and that these are usually above 80 meters long.
Events in port. Burgess also notes that for events, yachts can have more people aboard provided they stay in port.
Crew are separate. Crew members do not count toward the guest total, according to Burgess.
US waters: the six-passenger line
Smaller charters in US waters can meet a different number. The US Coast Guard's National Maritime Center describes its Operator of Uninspected Passenger Vessels endorsement as most appropriate for uninspected passenger vessels "which by law are limited to six or less passengers for hire." That rule applies in US waters, not in the BVI or the Mediterranean, but a caller asking for a day charter off Florida may run into it.
What this means for a charter inquiry
Ask for guests aboard, not cabins. Callers know how many people are coming. How that maps to cabins is the broker's work.
Take the number exactly as stated. "About a dozen" and "fourteen of us" lead to different shortlists.
Ask whether it is a cruise or an event. A dockside party and a week at sea are different requests.
Flag anything above 12 for the broker. It narrows the field and may change the vessel category entirely.
Do not promise a yacht will take the group. Certification, the flag and the yacht's own limits decide that, and the broker should confirm them.
For the question that should come before the guest count, see crewed or bareboat: why an inquiry should start there.
How the Watch handles this
The Thinking Robot builds AI phone agents, called the Watch, for businesses where a missed call is expensive. The yacht charter agent asks crewed or bareboat first, thinks in weeks rather than dates, and asks for guests rather than cabins. Call its demonstration line at (720) 676-0119 and tell it how many of you are going.
Tiers and prices are on the services page, and build time to go-live is four weeks. The Line Audit is $300, credited against setup, or you can book a call.
Frequently asked questions
Do crew count toward the 12-guest limit?
No. Burgess notes that crew members are counted separately from guests.
Can a charter yacht take more than 12 guests?
Some can. Yachts built to passenger yacht standards can carry more, and Burgess notes that some built to the Passenger Yacht Code take up to 36 guests, usually on yachts above 80 meters. For events in port, more people may be allowed aboard.
What is a six-pack charter?
It is the informal name for a charter in US waters on an uninspected vessel limited to six or fewer passengers for hire, run by a captain holding the Coast Guard's Operator of Uninspected Passenger Vessels endorsement.
Is the limit the same for every yacht?
No. It depends on how the yacht is built and certified, its flag and the waters it operates in. The yacht's management confirms the number for any specific charter.
