Terms

Terms of Service

First published July 2023 · This version effective October 26, 2026

These Terms govern your use of thethinkingrobot.com, our published phone and demonstration lines, the “Talk Live” button on this site, and any form, booking or purchase you make through them (together, the “Site”). They are an agreement between you and The Thinking Robot, Ltd. (“The Thinking Robot,” “we,” “us”).

If you are a client, or become one, your signed Order Form, Master Services Agreement and, where applicable, Business Associate Agreement or Data Processing Addendum (together, your “Agreement”) govern the services we provide to you and any dispute about them. If anything in these Terms or elsewhere on the Site — including prices, term, renewal, cancellation, included minutes, overage, liability or dispute resolution — differs from your Agreement, your Agreement controls. Nothing on the Site amends your Agreement, and nothing on the Site is an offer of terms different from those in your Order Form. A Watch subscription is formed only by a signed Order Form and Master Services Agreement, not by a form or payment on the Site alone.

Who can use the Site

You must be at least 18 years old. The Site is offered for business purposes. If you use it on behalf of a business, you confirm that you have the authority to bind that business to these Terms.

You are talking to AI

Our phone lines and the “Talk Live” button are answered by AI agents. Every agent says at the start of the call that it is an AI and, on every line that records, that the call is recorded. Calls are recorded and transcribed as described in our Privacy Policy; our executive protection demonstration line keeps no recording or transcript. By staying on the line after that notice, you consent to the recording and transcription. If you would rather not be recorded, hang up and email expand@thethinkingrobot.com instead.

Demonstration lines

The five numbers on our vertical pages are demonstrations. They do not book, quote or commit to anything real, and each one tells you it is a demonstration line. Please do not give them sensitive personal information.

Acceptable use

When using the Site, you agree not to:

  • break the law, or use the Site to harass, threaten or deceive anyone;
  • place automated, prerecorded or high-volume calls or texts to our lines;
  • try to get around our security, or reach information that is not yours;
  • submit another person’s information without their permission, or impersonate anyone;
  • try to make our agents produce unlawful or harmful content, or disrupt the Site’s operation;
  • copy our agents’ designs, prompts or outputs to build a competing service.

We may block numbers, addresses or devices that misuse the Site.

The Line Audit

The Line Audit costs $300 and is non-refundable. We call the number you give us, at the hours you are least likely to answer, record what happens, and send you the recordings with a written breakdown.

Each audit call begins by identifying The Thinking Robot and stating that the call is recorded and, where our caller is automated, that it is automated. By requesting an audit, you confirm that you own the line or are authorized to have it called and recorded, and you agree to let your staff and your answering service know that audit calls may arrive.

The breakdown records what we observed on the calls we placed. It is not a forecast. If you go on to sign an Order Form for a Watch, the $300 you paid is credited against the setup fee, as your Order Form will show.

Watch subscriptions, fees and renewal

These points summarize our standard terms. Your signed Order Form and Master Services Agreement are the binding terms and control if anything here differs.

  • Prices. Our tiers and current prices are set out on our services page: First Watch is $2,500 setup and $600 a month; Standing Watch and Silent Watch are $7,500 setup and $3,000 a month. Your Order Form states your setup fee, monthly subscription, included minutes and overage rate. We do not offer discounts, free trials, introductory pricing or an annual prepayment plan.
  • Setup fee. The setup fee is paid at signing, before the build begins, and is non-refundable. If you end the agreement after signing but before go-live, you owe the setup fee only; no monthly subscription is charged.
  • Twelve-month commitment. First Watch, Standing Watch and Silent Watch each have a twelve-month initial term that starts at go-live, billed monthly at the standard rate. Silent Watch is offered only under a written Order Form and Master Services Agreement prepared for that tier; no Watch can be purchased through the Site alone.
  • Automatic renewal. At the end of each term, your subscription renews automatically for another twelve months, billed monthly, unless you cancel renewal before the renewal date. We email you a reminder 35 days before each renewal date, stating the recurring amount, how often you are billed, the length of the renewal term and how to cancel. We give you at least 30 days’ notice of any price increase, and an increase takes effect only at the start of a renewal term — never during a term already under way.
  • Cancelling renewal. You can cancel renewal at any time, online, in one step — by replying “cancel renewal” to any billing email, by using the cancellation link where a billing email includes one, or by emailing support@thethinkingrobot.com. No phone call, interview or letter is required. Cancellation takes effect at the end of the current term; your service continues, and the monthly subscription remains payable, until then.
  • Ending early. If you choose to end your agreement for convenience before the end of a term, the monthly subscription remains payable through the end of that term. This does not apply if you end the agreement for cause, or under the 90-day performance benchmark exit in your Master Services Agreement; in those cases you owe fees only up to the date the agreement ends.
  • Included minutes and overage. Each subscription includes 1,000 connected call minutes a month, unless your Order Form states a different allowance. Each call is rounded up to the next whole minute; calls under ten seconds, calls before go-live and our own test calls are not counted. Unused minutes do not roll over. We email you automatically when you reach 80% and 100% of your allowance. Usage above the allowance is billed in blocks of 100 minutes, at $60 per block unless your Order Form states otherwise, on a separate itemized invoice after the month closes, due within seven days. Overage is never charged automatically to your card or account. You may dispute any invoice in writing within 30 days, and you may ask for the per-call records behind it. An unpaid overage invoice is collected as an ordinary debt; it never causes us to suspend or switch off your service.

No promised outcomes

We do not promise any particular number of calls answered, inquiries captured, bookings made or revenue earned or recovered. Agents can make mistakes. Review the records they produce, and keep a person responsible for the decisions that matter to your business.

Your records

For clients, the transcripts and records your agent produces belong to you. We use them to provide, support, secure and quality-check your service, as set out in your agreement with us. We don’t train AI models on your calls. The third-party providers that process calls for us, such as our phone platform, Vapi, may use call data in a form that does not identify your business or your callers to operate and improve their own services, including their AI models, as their terms and, where one is signed, their business associate agreement allow. For medical clients, we do not route protected health information through a provider until a business associate agreement with it is signed. To improve our service we may use data that has first been de-identified — stripped of anything that identifies you, your callers or your business — using a method that an independent reviewer validates at least once a year. For medical clients, protected health information is handled only as your Business Associate Agreement allows.

Our intellectual property

The Site’s content and design are owned by The Thinking Robot or our licensors. So are our agents’ designs, scripts and prompts, and the names The Watch, First Watch, Standing Watch, Silent Watch, The Line Audit, Rosey and Zeno. You may view and share pages for your own business use. Any other use needs our written permission.

If you believe something on the Site infringes your copyright, email support@thethinkingrobot.com with the details the law requires. We will review it promptly.

Other websites and services

The Site links to services we do not control, including our free Recon tool and our social media pages. Their own terms and policies apply, and we are not responsible for them.

Disclaimers

The Site and the demonstration lines are provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Site or our lines will always be available or free of errors.

Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the Site. Our total liability for any claim relating to the Site will not exceed the greater of $100 and the amount you paid us in the twelve months before the claim arose. Clients’ liability terms are set out in the Master Services Agreement.

Indemnity

If your misuse of the Site, or your breach of these Terms or of the law, leads to a claim against us, you agree to cover our reasonable losses and costs from that claim.

Governing law and disputes

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules.

Any dispute arising out of or relating to these Terms, the Site or the Line Audit will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, before a single arbitrator seated in Denver, Colorado. Judgment on the award may be entered in any court with jurisdiction. Instead of arbitration, either of us may bring an individual claim in small-claims court, or seek an injunction for misuse of intellectual property, breach of confidentiality or a data-security emergency in the state courts of Arapahoe County, Colorado, or the U.S. District Court for the District of Colorado. Nothing in this section limits the authority of any regulator.

CLAIMS MUST BE BROUGHT IN YOUR OR OUR INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING, AND YOU AND WE EACH WAIVE ANY RIGHT TO A JURY TRIAL. If this class waiver is found unenforceable for a particular claim, that claim alone will proceed in the courts named above.

The prevailing party may recover its reasonable attorneys’ fees and costs. A claim must be brought within one year after it arises, unless the law does not allow that period to be shortened.

This section applies to disputes that arise on or after October 12, 2026. If you are a client, the dispute-resolution terms of your Master Services Agreement govern any dispute relating to your service.

Text messaging terms

If you opt in to texts from The Thinking Robot, we send booking confirmations, reminders, replies to your requests and service notices. Message frequency varies. Message and data rates may apply. Consent to receive texts is not a condition of any purchase. Reply HELP for help, or contact support@thethinkingrobot.com or +1 (720) 953-3337. Reply STOP to opt out.

You can also opt out by replying with words such as “quit,” “end,” “cancel,” “unsubscribe,” “revoke” or “opt out,” or by telling us in any other reasonable way — by text, email or on a call. We honor every opt-out promptly, and always within ten business days, across every channel we use to contact you.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text-messaging opt-in data and consent are not shared with any third party, other than the carriers and service providers that deliver our messages. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for how we handle your number.

Changes to these Terms

We may update these Terms and will change the date at the top when we do. If we make a material change — including to how disputes are resolved — we will post the new version here at least 30 days before it takes effect. A change to dispute resolution does not apply to a dispute that arose before the change took effect. Continuing to use the Site after a change takes effect means you accept it. Changes to these Terms do not alter an Order Form you have already signed.
